By accessing or using RoaringShifts ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

These Terms constitute a legally binding agreement between you and RoaringShifts. Your continued use of the Platform constitutes acceptance of any updates to these Terms.

RoaringShifts is a comprehensive social media platform designed for automotive enthusiasts. Our services include:

• Social networking features for connecting with other enthusiasts

Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• One person may maintain only one account unless explicitly authorized
• Business accounts may be created for verified automotive service providers

Account Security

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• We may suspend or terminate accounts that violate these Terms

Acceptable Use

You agree to use RoaringShifts responsibly and in compliance with all applicable laws. You may:

• Engage in respectful discussions with other community members
• List vehicles and parts for sale with honest descriptions and pricing
• Organize or promote legitimate automotive events and meetups

Prohibited Activities

The following activities are strictly prohibited:

• Posting false, misleading, or fraudulent vehicle or parts listings
• Harassment, bullying, or threatening behavior toward other users
• Sharing illegal, offensive, or inappropriate content
• Attempting to circumvent platform safety measures or security features
• Using the platform for any illegal activities or transactions
• Spamming, soliciting, or engaging in unauthorized commercial activities
• Impersonating other users, businesses, or organizations
• Posting content that infringes on intellectual property rights

Vehicle and Parts Transactions

• RoaringShifts facilitates connections between buyers and sellers but is not party to transactions
• All listings must comply with local, provincial, and federal laws
• Sellers are responsible for accurate descriptions, legal ownership, and proper documentation
• Buyers are responsible for inspecting items and verifying seller claims before purchase

Fees and Payments

• Certain platform features may require subscription fees or listing charges
• Commission fees may apply to completed transactions through our platform
• All fees are clearly disclosed before charges are incurred
• Refund policies are detailed in our billing and payment documentation

Dispute Resolution

• Users are encouraged to resolve transaction disputes directly
• RoaringShifts may provide mediation assistance when requested
• Our dispute resolution process requires evidence and good faith participation
• Final resolution decisions are at RoaringShifts' discretion

Platform Role

• RoaringShifts provides technology platform for ticket sales and payment processing
• We facilitate connections between event organizers and attendees
• We collect platform fees and distribute payments to organizers
• We are NOT responsible for event planning, execution, safety, or outcomes

Ticket Sales Terms

• All ticket sales are final and non-refundable unless otherwise specified by the organizer
• Event location and specific timing details are revealed only after payment confirmation
• Ticket prices are set solely by event organizers
• Platform fees are clearly disclosed at time of purchase
• Payment processing is handled through secure third-party providers

Marketplace Fees

• RoaringShifts charges a platform fee on paid event ticket sales
• Current fee structure is disclosed during organizer onboarding
• Fees are automatically deducted from gross ticket sales
• HST/GST applies to platform fees as required by Canadian tax law

Legal and Regulatory Compliance

• Organizers must obtain all required permits, licenses, and authorizations
• Compliance with municipal, provincial, and federal laws is mandatory
• Venue agreements and insurance requirements are organizer's responsibility
• Safety protocols and emergency planning must be implemented
• Accessibility requirements must be met as required by law

Financial and Tax Obligations

• Organizers are responsible for all tax obligations on event revenue
• HST/GST registration and collection required if annual revenue exceeds $30,000 CAD
• Income tax reporting on all event proceeds is organizer's responsibility
• Business licensing may be required depending on event type and revenue
• Accurate financial records must be maintained for tax purposes

Liability and Insurance

• Organizers assume full liability for all event-related incidents
• General liability insurance is strongly recommended
• Property damage, personal injury, and theft are organizer's responsibility
• Organizers must indemnify RoaringShifts against all event-related claims

Organization Account Requirements

• Paid event organizers must register for an Organization account
• Business verification documentation may be required
• Valid payment information must be provided for fee collection
• Compliance with platform community guidelines is mandatory

Ticket Purchase and Attendance

• Ticket purchases constitute acceptance of event-specific terms set by organizers
• Attendees acknowledge that RoaringShifts is not the event organizer
• Event details (location, specific timing) are provided only after payment
• Tickets are personal and may not be transferable without organizer permission

Refund and Cancellation Policy

• All ticket sales are final and non-refundable by default
• Individual organizers may offer refunds at their sole discretion
• Event cancellations or changes are handled directly between organizers and attendees
• RoaringShifts is not responsible for refunds, cancellations, or event changes
• Platform fees are non-refundable regardless of event outcome

Assumption of Risk

• Attendees participate in events at their own risk
• Automotive events may involve inherent safety risks
• Organizers are solely responsible for event safety and security
• RoaringShifts disclaims all liability for event-related incidents

Platform Content

RoaringShifts owns all rights to the platform design, features, trademarks, and proprietary content. Users may not reproduce, distribute, or create derivative works without permission.

User Content

• You retain ownership of content you post but grant us license to use it on the platform
• You are responsible for ensuring you have rights to all content you share
• Content must not infringe on third-party intellectual property rights
• We may remove content that violates intellectual property laws

DMCA Compliance

We respond to valid copyright infringement notices under the Digital Millennium Copyright Act. Report copyright violations to our designated DMCA agent.

Your privacy is important to us. Our data collection, use, and protection practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

• Users assume full responsibility for their transactions and interactions
• Our liability is limited to the amount paid for platform services in the past 12 months

User Responsibility

Users are responsible for:

• Verifying the legality and safety of all transactions
• Conducting appropriate due diligence before purchases
• Complying with local laws and regulations
• Understanding the risks of peer-to-peer transactions

Account Termination

Either party may terminate the account relationship:

• Users may delete their accounts at any time through account settings
• We may suspend or terminate accounts for Terms violations
• Termination may be immediate for serious violations or illegal activity
• Notice will be provided when possible for account terminations

Effects of Termination

• Access to the platform and services will cease immediately
• User content may be removed or made inaccessible
• Outstanding obligations and liabilities survive termination
• Certain provisions of these Terms continue to apply

Jurisdiction

These Terms are governed by the laws of Canada and the province of Ontario. Any disputes will be resolved in the courts of Ontario, Canada.

Dispute Resolution Process

• Users agree to attempt good faith resolution before litigation

• Small claims court jurisdiction is preserved for applicable matters

Entire Agreement
